1. About these terms
By accessing or using homestack.au (“the Site”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Site. The Site is operated by the operator of homestack.au (ABN 42 922 821 474), referred to as “we,” “us,” or “our.” You must be at least 18 years old and an Australian resident for the Site to be practically useful to you.
2. What HomeStacker does
HomeStacker is a free information and calculation tool that helps Australian first home buyers understand which government schemes they may qualify for, including the First Home Super Saver Scheme (FHSS), the Australian Government 5% Deposit Scheme / First Home Guarantee (FHBG), Help to Buy, state First Home Owner Grants, and state stamp duty concessions. You enter your details into a wizard and receive an eligibility summary, estimated dollar savings, and a suggested sequence of actions.
3. General information only — not advice
HomeStacker provides general information only. It is NOT financial advice, legal advice, tax advice, credit assistance, or investment advice. We do not hold an Australian Financial Services Licence (AFSL) or an Australian Credit Licence (ACL). The information on this Site should not be relied upon as a substitute for professional advice tailored to your personal circumstances. Before making any financial decision, you should consult a licensed financial adviser, mortgage broker, accountant, or solicitor.
4. Accuracy and currency
Government scheme rules, eligibility criteria, income thresholds, property price caps, grant amounts, and stamp duty rates change frequently and sometimes without notice. While we make reasonable efforts to keep the Site accurate and up to date, we do not guarantee that any information is correct, complete, or current at the time you access it. You must verify all information with the relevant government authority or a licensed professional before making any decision based on it.
5. No warranties
To the maximum extent permitted by law, the Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, reliability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
6. Limitation of liability
To the maximum extent permitted by Australian law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our total aggregate liability to you for any claim arising out of or relating to the Site or these Terms, whether in contract, tort (including negligence), statute, or otherwise, is limited to the amount you have paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement. If we are liable to you under a non-excludable consumer guarantee, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having the service resupplied.
7. Intellectual property
All content on the Site, including text, calculations, design, logos, and code, is owned by or licensed to us and is protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent.
8. Prohibited uses
You must not:
- scrape, crawl, or use automated tools to access the Site without our written permission;
- reverse engineer, decompile, or disassemble any part of the Site;
- republish, redistribute, or commercially exploit the outputs of the calculator without our written consent;
- use the Site in any way that could damage, disable, or impair it, or interfere with any other party's use of the Site;
- attempt to gain unauthorised access to any part of the Site or its systems.
9. Broker referrals and third-party links
When you opt into a broker referral through the Site, you are choosing to share your contact details with an independent licensed mortgage broker. That broker is a separate entity and operates under their own Australian Credit Licence. Your relationship with the broker is governed by their own terms, disclosures, and legal obligations under the National Consumer Credit Protection Act 2009 (Cth). We receive a referral fee from the broker for this introduction, which we disclose here for transparency. We do not control, endorse, or accept responsibility for any advice, product, or service provided by the broker or any other third party linked from the Site.
10. Paid products
We offer a downloadable PDF strategy report available for purchase through Stripe. Once the PDF has been delivered electronically, no refund is available except where required by the Australian Consumer Law. Payment is processed by Stripe. We do not store your credit card details.
11. User accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
12. Changes to these terms
We may update these Terms at any time by publishing the revised version on the Site with an updated date. Your continued use of the Site after changes are published constitutes your acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
